These are the terms you agree to when you use Honed. We've kept them as plain as we can, but the full terms below are what govern your use of our service. Using our website or buying a panel means you accept them, along with our Privacy Policy.
The short version
- Honed gives you a GP-issued pathology referral and shows your results. It's information, not medical advice.
- You need to be 18 or over and an Australian resident.
- Because your referral is issued as soon as you pay, we can't offer change-of-mind refunds. Your Australian Consumer Law rights always apply.
- We handle your information in line with our Privacy Policy.
- To the maximum extent the law allows, our liability is limited to what you paid for your order, and we aren't liable for indirect or consequential loss.
- Always talk to a doctor about your results. In an emergency, call 000.
Who we are and what this covers
These terms (Terms) are an agreement between Simple AI Agency Pty Ltd (ABN 43 694 759 763), trading as Honed Health ("Honed Health" or "Honed", "we", "us", "our"), and you, the person who uses our website or buys our services.
Honed Health lets you order a blood test panel online and view the resulting data. That means:
- ordering blood test panels through our website;
- a pathology referral generated by an Australian-registered medical practitioner engaged by us;
- collection of your sample at a partner, NATA-accredited pathology collection centre; and
- your results, shown securely in your patient portal with personalised, plain-English commentary.
Our services don't include medical consultation, diagnosis, treatment, prescribing, or ongoing clinical monitoring.
Accepting these terms
By ticking the box at checkout, or by using our website or buying our services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use our services.
We may update these Terms from time to time. If we make a material change, we'll let you know by email or through the site. If you keep using Honed after the change takes effect, or 30 days after we notify you, whichever is earlier, you accept the updated Terms.
Your licence to use Honed
We give you a personal, non-exclusive, non-transferable, revocable licence to use our website and patient portal for your own personal health purposes, in line with these Terms. All other uses need our written permission.
When you use Honed, you must not:
- do anything unlawful, or breach anyone else's rights or privacy, including uploading someone else's personal information without their consent;
- use Honed to harass, threaten, or offend anyone, or to send unsolicited messages;
- tamper with or interfere with the site or portal, including by introducing viruses or malicious code;
- scrape, data-mine, or use bots or similar tools to extract data from Honed; or
- help anyone else do any of the above.
This isn't medical advice
Our services don't constitute medical advice, diagnosis, or treatment. Your results, and any commentary, reference ranges, or recommendations shown alongside them, are provided for information only and on an "as is" basis. They are based on general population and clinical guidelines, not on your full medical history, and they aren't a substitute for advice from a qualified healthcare provider who knows your circumstances.
It's your responsibility to decide how useful and suitable our service is for you, and any reliance on the information we provide is at your own risk. If you have any concerns about your health or your results, please see a registered medical practitioner. In an emergency, call 000.
In line with the Therapeutic Goods Act 1989 (Cth) and AHPRA's advertising requirements, we make no claim that our services diagnose, cure, treat, or prevent any disease or condition.
Our use of AI
We use artificial intelligence (AI) tools to help us run Honed, improve our service, and support you, including to help analyse and explain your results, assist customer support, and improve our products and services (training models on de-identified data only).
AI doesn't make clinical decisions, diagnose you, or replace professional medical judgement. Any result interpretation that involves AI is general information only, not a diagnosis, and any AI-involved decision that could significantly affect you is reviewed by a person. Our full approach is set out in our Privacy Policy.
Who can use Honed
To use Honed, you must:
- be at least 18 years old;
- be an Australian resident with a valid Australian residential address;
- have the legal capacity to enter into this agreement; and
- give us accurate and complete information when you order.
We may refuse or cancel an order if we reasonably believe these criteria aren't met. Our services aren't available outside Australia.
Your patient portal account
You create an account to view your results in the patient portal. When you do, you agree to:
- give us accurate information and keep it up to date;
- keep your login details confidential and not share your account with anyone; and
- tell us promptly if you think someone has used your account without permission.
Your account is personal to you and you're responsible for activity that happens under it. You must not transfer your account to anyone else.
Your health information and consent
Your blood test results and health goals are sensitive information under the Privacy Act. Before we collect your health information, we ask for your consent at checkout, including for the AI uses described above and in our Privacy Policy. You can withdraw your consent by contacting us at hello@honed.health, though this may affect our ability to provide the service. We handle all of your information in line with our Privacy Policy, which forms part of these Terms.
Orders, payment, and refunds
All prices are in Australian dollars and include GST where it applies. Payment is handled securely by our payment provider, and we never see or store your card details. We may change our prices at any time, but a change won't affect an order you've already placed.
Your referral is generated and issued to you as soon as your payment is confirmed. Because the referral is the main thing you're paying for, and we incur non-refundable costs the moment it's issued, we can't cancel or refund an order for change of mind once payment is complete. Please check your panel and your details carefully before you pay.
None of this affects your rights under the Australian Consumer Law. If we don't deliver, for example the referral isn't generated or can't be used to collect your sample, you're entitled to a remedy, which may be a refund or a replacement referral. Nothing in these Terms excludes any consumer guarantee that can't lawfully be excluded.
What we ask of you
When you use Honed, you agree to:
- give us accurate personal and health information when you order;
- follow the collection centre's instructions, including any fasting requirements before your sample is taken;
- use your referral yourself, since it's issued in your name only, and not share or transfer it; and
- use our services only for lawful purposes.
You're responsible for the accuracy of the information you give us. If a result is affected by inaccurate information you provided, for example a wrong date of birth affecting age-based reference ranges, we aren't responsible for the cost of re-testing.
Your warranties to us
You confirm that there's nothing legally preventing you from entering into these Terms, that the information you give us is true, current, and complete and that we'll rely on it to provide the service, and that you've read and understood these Terms and our Privacy Policy.
Our content and intellectual property
Everything on honed.health and in your portal, including text, images, logos, designs, software, and any models we use, is owned by or licensed to Honed Health and protected by Australian and international intellectual property law. We grant you a personal, non-transferable licence to use it for your own health purposes only.
Without our written permission, you must not copy, reproduce, distribute, sell, publish, modify, or create derivative works from our content, or embed it elsewhere. If you give us feedback or suggestions, you agree we can use them without obligation to you. This section continues to apply after these Terms end.
The providers we work with, and service availability
We rely on trusted providers to run Honed, including our accredited Australian pathology partner, our payment provider, and our hosting and email providers. We take reasonable care in choosing and overseeing them, but we aren't responsible for their own acts or omissions.
We use reasonable efforts to keep our website and portal available, but we don't guarantee uninterrupted access. We may carry out scheduled or emergency maintenance, and access may depend on third-party services outside our control. To the maximum extent the law allows, we aren't liable for any unavailability caused by those third-party services, or for any loss or corruption of data.
Australian Consumer Law
Our services come with guarantees that can't be excluded under the Australian Consumer Law (ACL), such as that they'll be provided with due care and skill and be reasonably fit for purpose. Nothing in these Terms excludes, restricts, or modifies those rights (your Consumer Law Rights).
Where the ACL applies to you as a consumer, our liability for our services is governed by the ACL and these Terms. Subject to your Consumer Law Rights, we otherwise exclude all express and implied warranties, and our services are provided without warranties of any kind. This section continues to apply after these Terms end.
Our liability
To the maximum extent the law allows:
- you agree to cover us for any liability we incur because you breached the licence or intellectual property sections of these Terms;
- neither you nor we are liable to the other for any indirect or consequential loss, including loss of profits, revenue, goodwill, opportunity, or data;
- each party's liability is reduced to the extent the other party, or its people, caused or contributed to it, including by failing to limit its own loss; and
- our total liability to you for any claim arising from your use of our services is limited to the amount you paid us for the relevant order.
We're not liable for medical decisions made, or not made, based on the information in your portal. Those decisions are between you and your treating practitioner. This section continues to apply after these Terms end.
Suspension and termination
You can close your account at any time by emailing hello@honed.health.
If we reasonably suspect you're in breach of these Terms, we may suspend your access while we investigate. We may end your access if you breach a material term and don't fix it within 10 business days of us asking you to.
When your access ends, we'll remove it and delete your account, except that we may need to keep certain records to meet our obligations under health-records and other applicable laws (see our Privacy Policy). Ending your access doesn't affect any rights or obligations that have already built up, and the sections meant to continue, including intellectual property, Australian Consumer Law, and liability, survive.
General
Access. Honed is intended for use in Australia. If you access it from elsewhere, you do so at your own risk and are responsible for complying with local laws.
Assignment. You can't transfer your rights or obligations under these Terms without our consent. We may transfer ours to a successor entity, for example if our business is sold or restructured. You agree we may assign any debt you owe us to a third party such as a debt collector.
Disputes. Before starting court proceedings, you agree to first meet with us to try, in good faith, to resolve the dispute, and then to attempt mediation if needed, sharing the cost equally. This doesn't stop either of us from seeking urgent relief from a court.
Force majeure. To the maximum extent the law allows, we aren't liable for any failure or delay caused by events outside our reasonable control.
Governing law. These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. The courts of Western Australia have exclusive jurisdiction over any dispute.
Notices. Notices must be in writing. You can reach us at hello@honed.health; our registered office address is available on request. We'll send notices to the details in your account.
Privacy. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. See our Privacy Policy.
Third-party sites. Our site may link to websites we don't control. We're not responsible for their content, and we recommend you review their own terms.
Severability. If part of these Terms can't be enforced, the rest stay in full effect.
Definitions
- Consequential loss means any indirect or consequential loss, and any loss of profit, revenue, business, goodwill, opportunity, savings, reputation, or use, and any loss or corruption of data, however it arises.
- Consumer Law Rights means your rights, guarantees, and remedies under the Australian Consumer Law that can't be excluded, restricted, or modified.
- Health information has the meaning given in the Privacy Act 1988 (Cth), and includes information about your health, blood test results, and health goals.
- Liability means any expense, cost, liability, loss, damage, claim, demand, proceeding, or judgment, however arising, whether direct or indirect.
